Achieved through significant grassroots struggle, the right to Independent Technical Advisory Services (ATI) is enshrined in law, as outlined in the National Policy for People Affected by Dams (Law No. 14.755, December 15, 2023) and the State Policy for People Affected by Dams (Law No. 23.795, January 15, 2021). It is no coincidence that society has mobilized—and continues to mobilize—to defend this right. This achievement stems from the aftermath of the catastrophic disasters in Mariana on November 5, 2015, and Brumadinho on January 25, 2019. Together, these dam collapses caused nearly 300 deaths and inflicted profound socio-environmental damage and trauma on the population of Minas Gerais and Brazil, which still lives under the constant threat of new disasters.

This is the reality faced by Antônio Pereira, a district of Ouro Preto, grappling with an alarming overlap of damages caused by predatory mining practices. The community lives under the shadow of terror imposed by the “ticking time bomb” that is the Doutor Dam, owned by Vale—the same company responsible for Brazil’s two most devastating socio-environmental mining dam disasters. Independent technical advisory services are a cornerstone of guaranteeing other rights. Through the work of the ATI, the population gains access to information that translates the harms they endure into the recognition of human rights violations.

Who benefits from undermining ATIs? Who stands to gain from suspending the work of an ATI?

The withdrawal of the Technical Advisory Service from Antônio Pereira, without completing the registration of affected individuals, producing the Damage Matrix, or finalizing the reparation plan, jeopardizes the comprehensive reparation of the district’s population. Moreover, it exacerbates the imbalance in technical and economic resources between mining companies and the local community.

Given this scenario, we, the Instituto Guaicuy, a nonprofit civil society organization with public utility status, registered under CNPJ No. 04.518.749/0001-86, elected as the Independent Technical Advisory Service for Antônio Pereira with 63% of the votes, hereby present this Manifesto to demand a solution for the continuation of the ATI in the territory.
